Terms and Conditions for Membership in The Lucky Passport LLC
1. Your Rights and Obligations as a Member of The Lucky Passport LLC ("TLP")
The Lucky Passport is a membership-based travel community. Membership provides access to the member portal, engagement activities, promotions, and community participation opportunities. Membership does not constitute the purchase of travel services, lodging, transportation, or any guaranteed prize. Members pay a recurring subscription fee (currently $14/month) for participation in the club and access to community features and promotions. Membership fees support operation of the platform and community programming.
Membership allows participation in trip giveaways. Trips and prizes are promotional awards and are not purchased by members. Membership does not increase the odds of winning beyond the number of entries submitted in accordance with official rules.
A free method of entry is available for each trip giveaway promotion as outlined in the Official Trip Giveaway Rules.
(a) THIS DOCUMENT CONTAINS VERY IMPORTANT INFORMATION REGARDING YOUR RIGHTS AND OBLIGATIONS, AS WELL AS CONDITIONS, LIMITATIONS, AND EXCLUSIONS THAT MIGHT APPLY TO YOU. PLEASE READ IT CAREFULLY.
(b) THESE TERMS REQUIRE THE USE OF ARBITRATION ON AN INDIVIDUAL BASIS TO RESOLVE DISPUTES, RATHER THAN JURY TRIALS OR CLASS ACTIONS.
(c) BY JOINING THE LUCKY PASSPORT AND PARTICIPATING IN THE OFFERS ON ITS WEBSITE, YOU AFFIRM THAT YOU ARE OF THE AGE OF 21 OR OVER TO ENTER INTO THIS AGREEMENT, AND YOU ACCEPT AND ARE BOUND BY THESE TERMS AND CONDITIONS. YOU AFFIRM THAT YOU ARE ONLY ACTING ON BEHALF OF YOURSELF AND BINDING ONLY YOU TO THESE TERMS AND CONDITIONS. YOU ACKNOWLEDGE THAT YOU DO NOT HAVE THE LEGAL AUTHORITY TO BIND AN ORGANIZATION OR COMPANY TO THESE TERMS AND CONDITIONS.
(d) YOU MAY NOT PARTICIPATE IN THE OFFERS OR ENJOY THE BENEFITS OF THIS WEBSITE IF YOU (A) DO NOT AGREE TO THESE TERMS, (B) ARE NOT THE OLDER OF (i) AT LEAST 18 YEARS OF AGE OR (ii) LEGAL AGE TO FORM A BINDING CONTRACT WITH TLP, OR (C) ARE PROHIBITED FROM ACCESSING OR USING THIS WEBSITE OR ANY OF THIS WEBSITE'S CONTENTS OR OFFERS BY APPLICABLE LAW.
(e) These terms and conditions (these "Terms") apply to all offers and membership benefits through TLP's website (the "Site"). These Terms are subject to change by TLP (referred to as "us", "we", or "our" as the context may require) without prior written notice at any time, in our sole discretion. Any changes to the Terms will be in effect as of the "Last Updated Date" referenced on the Site. You should review these Terms before participating in any offer or activity available through this Site. Your continued use of this Site after the "Last Updated Date" will constitute your acceptance of and agreement to such changes.
(f) These Terms are an integral part of the Website Terms of Use that apply generally to the use of our Site. You should also carefully review our Privacy Policy before participating in any activity or offer through this Site (see Section 6).
2. Nature of Membership
Membership provides:
- Access to the online member portal
- Participation in engagement activities
- Access to submit stamps into travel giveaways
- Community polls and engagement challenges
- Promotional reward points ("Stamps")
Stamps:
- Have no cash value
- Are not property
- Cannot be sold, transferred, or exchanged
- Do not guarantee a prize
- Are solely a promotional engagement tool
3. Participation and Cancellation
You agree that your participation in any activity or offer is governed by these Terms. We may choose not to accept participation at our sole discretion, even after we send you a confirmation email with confirmation of your request.
4. Prices and Payment Terms
(a) Membership automatically renews monthly unless canceled. All prices, discounts, and promotions posted on this Site are subject to change without notice. The price charged for any offer will be the price in effect at the time the order is placed and will be set out in your confirmation email. Price increases will only apply to orders placed after such changes. Posted prices do not include taxes, fees, or any charges for shipping and/or handling which may apply. All such taxes and charges will be added to your total and will be itemized in your shopping cart and your order confirmation email. We strive to display accurate price information, however, we may, on occasion, make inadvertent typographical errors, inaccuracies, or omissions related to pricing and availability. We reserve the right to correct any errors, inaccuracies, or omissions at any time and to cancel any orders arising from such occurrences.
(b) TLP reserves the right to suspend or terminate memberships for:
- Fraudulent activity
- Chargebacks
- Abuse of promotions
- Violation of community conduct rules
- Any other reason at our sole discretion
(c) We may offer, from time to time, promotions on the Site that may affect pricing and that are governed by terms and conditions separate from these Terms. If there is a conflict between the terms for a promotion and these Terms, the promotion terms will govern.
(d) Terms of payment are within our sole discretion and, unless otherwise agreed by us in writing, payment must be received by us before we accept an order. We accept major credit and debit cards, including Visa, Mastercard, American Express, and Discover. We may also accept digital wallet payments (such as ApplePay and Google Pay) and other payment methods supported by our payment processor, Stripe. You represent and warrant that (i) the credit card information you supply to us is true, correct, and complete, (ii) you are duly authorized to use such credit card for the purchase, (iii) charges incurred by you will be honored by your credit card company, and (iv) you will pay charges incurred by you at the posted prices, including shipping and handling charges and all applicable taxes, if any, regardless of the amount quoted on the Site at the time of your order.
5. Cancellations
Members may cancel their membership at any time through their account portal. CANCELLATION STOPS FUTURE BILLING BUT DOES NOT REFUND PRIOR BILLING PERIODS ALREADY PROCESSED.
(a) TLP IS NOT A TRAVEL AGENCY AND DOES NOT SELL TRAVEL PACKAGES TO MEMBERS. ANY TRAVEL PRIZE IS AWARDED THROUGH A TRIP GIVEAWAY AND FULFILLED THROUGH THIRD-PARTY TRAVEL PROVIDERS. WE MAKE NO WARRANTIES WHATSOEVER WITH RESPECT TO THE TRAVEL PRIZES OR ANY OTHER OFFER OFFERED ON THIS SITE, INCLUDING, WITHOUT LIMITATION, ANY (A) WARRANTY OF MERCHANTABILITY; (B) WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE; OR (C) WARRANTY AGAINST INFRINGEMENT OF INTELLECTUAL PROPERTY RIGHTS OF A THIRD PARTY; WHETHER EXPRESS OR IMPLIED BY LAW, COURSE OF DEALING, COURSE OF PERFORMANCE, USAGE OF TRADE, OR OTHERWISE.
(b) SOME JURISDICTIONS LIMIT OR DO NOT ALLOW THE DISCLAIMER OF IMPLIED OR OTHER WARRANTIES SO THE ABOVE DISCLAIMER MAY NOT APPLY TO YOU.
(c) YOU AFFIRM THAT WE SHALL NOT BE LIABLE, UNDER ANY CIRCUMSTANCES, FOR ANY BREACH OF WARRANTY CLAIMS OR FOR ANY DAMAGES ARISING OUT OF THE TRAVEL PROVIDER'S FAILURE TO HONOR ITS WARRANTY OBLIGATIONS TO YOU.
6. Limitation of Liability
(a) IN NO EVENT SHALL WE BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY LOSS RELATED TO TRAVEL TO INCLUDE WITHOUT LIMITATION, TRAVEL CANCELLATIONS, WEATHER DELAYS, LOST LUGGAGE, PERSONAL INJURY, OR DEATH, THIS INCLUDES CONSEQUENTIAL, INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE OR ENHANCED DAMAGES, LOST PROFITS OR REVENUES OR DIMINUTION IN VALUE, ARISING OUT OF, OR RELATING TO, AND/OR IN CONNECTION WITH ANY BREACH OF THESE TERMS, REGARDLESS OF (A) WHETHER SUCH DAMAGES WERE FORESEEABLE, (B) WHETHER OR NOT WE WERE ADVISED OF THE POSSIBILITY OF SUCH DAMAGES AND (C) THE LEGAL OR EQUITABLE THEORY (CONTRACT, TORT, OR OTHERWISE) UPON WHICH THE CLAIM IS BASED.
(b) OUR SOLE AND ENTIRE MAXIMUM LIABILITY, FOR ANY REASON, AND YOUR SOLE AND EXCLUSIVE REMEDY FOR ANY CAUSE WHATSOEVER, SHALL BE LIMITED TO THE ACTUAL AMOUNT PAID BY YOU FOR MEMBERSHIP YOU HAVE ORDERED THROUGH OUR SITE.
(c) The limitation of liability set forth in Section 6(b) shall only apply to the extent permitted by law.
7. Privacy
We respect your privacy and are committed to protecting it. Our Privacy Policy governs the processing of all personal data collected from you in connection with your participation in offers or activities through the Site.
8. Force Majeure
We will not be liable or responsible to you, nor be deemed to have defaulted or breached these Terms, for any failure or delay in our performance under these Terms when and to the extent such failure or delay is caused by or results from acts or circumstances beyond our reasonable control, including, without limitation, acts of God, flood, fire, earthquake, explosion, governmental actions, war, invasion or hostilities (whether war is declared or not), terrorist threats or acts, riot or other civil unrest, national emergency, revolution, insurrection, epidemic, lockouts, strikes or other labor disputes (whether or not relating to our workforce), or restraints or delays affecting carriers or inability or delay in obtaining supplies of adequate or suitable materials, materials or telecommunication breakdown or power outage.
9. Governing Law and Jurisdiction
This Site is operated from the United States. All matters arising out of or relating to these Terms are governed by and construed in accordance with the internal laws of the State of Texas without giving effect to any choice or conflict of law provision or rule (whether of the State of Texas or any other jurisdiction) that would cause the application of the laws of any jurisdiction other than those of the State of Texas.
10. Dispute Resolution and Binding Arbitration
(a) YOU AND TLP ARE AGREEING TO GIVE UP ANY RIGHTS TO LITIGATE CLAIMS IN A COURT OR BEFORE A JURY, OR TO PARTICIPATE IN A CLASS ACTION OR REPRESENTATIVE ACTION WITH RESPECT TO A CLAIM. OTHER RIGHTS THAT YOU WOULD HAVE IF YOU WENT TO COURT MAY ALSO BE UNAVAILABLE OR MAY BE LIMITED IN ARBITRATION. ANY CLAIM, DISPUTE, OR CONTROVERSY (WHETHER IN CONTRACT, TORT, OR OTHERWISE, WHETHER PRE-EXISTING, PRESENT, OR FUTURE, AND INCLUDING STATUTORY, CONSUMER PROTECTION, COMMON LAW, INTENTIONAL TORT, INJUNCTIVE AND EQUITABLE CLAIMS) BETWEEN YOU AND US ARISING FROM OR RELATING IN ANY WAY TO YOUR PARTICIPATION IN ACTIVITIES OR OFFERS THROUGH THE SITE, WILL BE RESOLVED EXCLUSIVELY AND FINALLY BY BINDING ARBITRATION.
(b) The arbitration will be administered by the American Arbitration Association ("AAA") in accordance with the Consumer Arbitration Rules (the "AAA Rules") then in effect, except as modified by this Section 9. (The AAA Rules are available at www.adr.org/arb_med or by calling the AAA at 1-800-778-7879.) The Federal Arbitration Act will govern the interpretation and enforcement of this section. The arbitrator will have exclusive authority to resolve any dispute relating to arbitrability and/or enforceability of this arbitration provision, including any unconscionability challenge or any other challenge that the arbitration provision or the agreement is void, voidable, or otherwise invalid. The arbitrator will be empowered to grant whatever relief would be available in court under law or in equity. Any award of the arbitrator(s) will be final and binding on each of the parties and may be entered as a judgment in any court of competent jurisdiction.
(c) In any dispute, NEITHER YOU NOR TLP WILL BE ENTITLED TO JOIN OR CONSOLIDATE CLAIMS BY OR AGAINST OTHER CUSTOMERS IN COURT OR ARBITRATION OR OTHERWISE PARTICIPATE IN ANY CLAIM AS A CLASS REPRESENTATIVE, CLASS MEMBER OR IN A PRIVATE ATTORNEY GENERAL CAPACITY. The arbitral tribunal may not consolidate more than one person's claims and may not otherwise preside over any form of representative or class proceeding. The arbitral tribunal has no power to consider the enforceability of this class arbitration waiver and any challenge to the class arbitration waiver may only be raised in a court of competent jurisdiction.
If any provision of this arbitration agreement is found unenforceable, the unenforceable provision will be severed, and the remaining arbitration terms will be enforced.
11. Assignment
You will not assign any of your rights or delegate any of your obligations under these Terms without our prior written consent. Any purported assignment or delegation in violation of this Section 11 is null and void. No assignment or delegation relieves you of any of your obligations under these Terms.
12. No Waivers
The failure by us to enforce any right or provision of these Terms will not constitute a waiver of future enforcement of that right or provision. The waiver of any right or provision will be effective only if in writing and signed by a duly authorized representative of TLP.
13. No Third-Party Beneficiaries
These Terms do not and are not intended to confer any rights or remedies upon any person other than you.
14. Notices
(a) To You. We may provide any notice to you under these Terms by (i) sending a message to the email address you provide or (ii) by posting to the Site. Notices sent by email will be effective when we send the email and notices we provide by posting will be effective upon posting. It is your responsibility to keep your email address current.
(b) To Us. To give us notice under these Terms, you must contact us as follows: (i) by email to hello@theluckypassport.org; or (ii) by personal delivery, overnight courier, or registered or certified mail to The Lucky Passport, 10228 E Northwest Hwy, Unit 560, Dallas, TX 75238. We may update the facsimile number or address for notices to us by posting a notice on the Site. Notices provided by personal delivery will be effective immediately. Notices provided by facsimile transmission or overnight courier will be effective one business day after they are sent. Notices provided by registered or certified mail will be effective three business days after they are sent.
15. Severability
If any provision of these Terms is invalid, illegal, void, or unenforceable, then that provision will be deemed severed from these Terms and will not affect the validity or enforceability of the remaining provisions of these Terms.
16. Entire Agreement
These Terms, our Website Terms of Use, and our Privacy Policy will be deemed the final and integrated agreement between you and us on the matters contained in these Terms.
Disclaimer
The Lucky Passport ("TLP") is committed to making every reasonable effort to provide the travel opportunities and experiences featured on our platform. However, the world can be unpredictable, and travel conditions may change due to events outside of TLP's control.
TLP cannot be held responsible for delays, cancellations, schedule changes, or the inability to complete any travel opportunity due to government actions or restrictions (foreign or domestic), changes in laws or regulations, travel advisories, public health concerns, natural disasters, weather events, transportation disruptions, civil unrest, acts of war, or any other circumstance that may affect travel safety, legality, or availability.
If unforeseen circumstances impact a trip or experience, TLP reserves the right to modify, substitute, postpone, reschedule, or cancel the offering as necessary.

We cannot delete your personal information except by also deleting your user account. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.

Your State Privacy Rights
California, Colorado, Connecticut, Delaware, Florida, Indiana, Iowa, Montana, Oregon, Tennessee, Texas, Utah, and Virginia provide (now or in the future) their state residents with rights to:

The Lucky Passport Trip Giveaway Official Rules
1. How to Enter
Beginning on the start date and ending on the end date of the promotional period, visit www.theluckypassport.org and follow the on-screen instructions to submit an entry for the applicable Trip Giveaway.
Limit: Up to one hundred fifty (150) total entries ("Stamps") per person per Trip Giveaway, regardless of method of participation. Members may receive Stamps through membership benefits and other promotional activities as described by Sponsor. Non-members may obtain up to one (1) Mail-In Entry Request per day during the applicable Giveaway Period, with each valid Mail-In Entry Request receiving three (3) Stamps. The maximum number of Stamps that may be obtained through the mail-in method is one hundred fifty (150) per Giveaway. Use of automated, robotic, programmed, or similar entry methods is prohibited and will result in disqualification. Entries submitted using multiple identities, email addresses, accounts, or devices in an attempt to circumvent these Official Rules are prohibited and may result in disqualification. Any attempt to exceed stated limits may void all associated entries and result in disqualification.
Member Entry Method: Registered members earn entries ("Stamps") through designated engagement activities available within the platform. Each eligible Stamp will be applied as one (1) entry into the selected Trip Giveaway. Stamps have no cash value and are subject to applicable program terms.
NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING.
Non-Member Alternate Method of Entry (AMOE): Non-member Participants may enter without making any purchase or becoming a paid member. To participate, participants must first create a free account at theluckypassport.org which does not require any purchase or payment, and then submit a mail-in entry request in accordance with these Official Rules. Mail-in entries have the same odds of winning as entries obtained through any other entry method. No purchase, payment, or online account activity increases odds of winning.
To enter by mail, participants must handwrite their request on a 3"x 5" index card and include:
- Full name associated with The Lucky Passport account
- Physical mailing address
- Email address associated with The Lucky Passport account
- Phone number
- The specific Trip Giveaway for which entry is requested
Place the completed request card in a standard #10 envelope with proper postage and mail it to:

Each mail-in request must be mailed separately in an individual envelope. Mail-in requests must be handwritten, complete, legible, and accurately match the participant's The Lucky Passport account information. Mail-in requests must be postmarked and received at least four (4) business days prior to the applicable entry deadline to allow sufficient time for processing and verification.
Each valid mail-in request will result in one (1) Stamp (entry) for the specified Trip Giveaway, subject to applicable entry limits. Incomplete, illegible, inaccurate, mechanically reproduced, postage-due, misdirected, or otherwise non-compliant requests may be void and will not be processed. Promotion Parties are not responsible for lost, late, damaged, delayed, postage-due, or undelivered mail-in requests.
Upon receipt and verification of a valid mail-in request, The Lucky Passport will apply one (1) Stamp (entry) to the selected Trip Giveaway within three (3) business days.
All required information must be completed in full to be eligible. Incomplete, illegible, corrupted, or non-compliant entries may be deemed void at Sponsor's sole discretion, regardless of method of entry.
2. Eligibility
Open to legal residents of the fifty (50) United States and the District of Columbia, twenty-one (21) years of age or older at the time of entry. Employees of The Lucky Passport, which acts as the Sponsor and Administrator of this Trip Giveaway, and their respective affiliates, subsidiaries, advertising and promotional agencies, and any other entities involved in the development, administration, or execution of this Trip Giveaway (collectively, the "Promotion Parties"), as well as the immediate family members (spouse, parent, child, sibling, and their respective spouses, regardless of where they reside) and/or members of the same household of such employees, are not eligible to participate.
